CRYPTOMERIAN USER AGREEMENT
1. STATEMENT
CRYPTOMERIAN holds the right to own and run this website. The User undertakes to read the entire Service Agreement carefully before using the Site or any of the services provided by CRYPTOMERIAN. The User undertakes to comply with any and all applicable laws and regulations. The User agrees to be responsible for all information provided to CRYPTOMERIAN and holds all the rights to purchase investment products with CRYPTOMERIAN.
2. REGISTRATION
2.1 User qualification. The User can be individuals, companies or other organizations. Individuals should be person with full capacity for civil conduct. CRYPTOMERIAN doesn’t provide services for minors or other restricted groups.
2.2 Required materials. By registering with CRYPTOMERIAN, the User agrees to provide CRYPTOMERIAN with current, accurate, and complete information about him/herself as prompted by the registration process, and to keep such information updated.
2.3 In the case of fraud, CRYPTOMERIAN undertakes to report all the necessary information, including names, addresses and all other requested information, to the relevant authorities dealing with fraud and breaches of the law. Users recognize that their account may be frozen at any time at the request of any competent authority investigating a fraud or any other illegal activity.
3. NOTIFICAITON
Necessary notifications will be sent to users in the form of newsletter, Email etc.
4. PRIVACY POLICY
We may use your Personal Information for the following purposes:
1) as required for regulatory purposes;
2) to provide you with information about products and promotions that may be of interest to you, from ourselves and third parties, although only if you have specifically agreed to receive such information;
3) for market research e.g. surveying our Members' needs and opinions on issues, such as our performance etc.
We will process your Personal Information only for the purpose(s) for which it has been provided to us.
5. ACCOUNT SECURITY
5.1 The User must take all reasonable steps to keep his/her CRYPTOMERIAN Account password safe all the time and never disclose it to anyone. CRYPTOMERIAN personnel will never ask the User to provide his/her password to CRYPTOMERIAN or to a third party.
5.2 If the User has any indication or suspicion of his/her CRYPTOMERIAN Account, login details, password or other security feature being lost, stolen, misappropriated, used without authorization or otherwise compromised, please inform CRYPTOMERIAN immediately.
6. MODIFICATION OF SERVICE TERMS
CRYPTOMERIAN reserves the right to change, add or remove portions of these Terms, at any time, in an exercise of its sole discretion. You will be notified of any changes in advance through your Account. Upon such notification, it is your responsibility to review the amended Terms. Your continued use of the Site following the posting of a notice of changes to the Terms signifies that you accept and agree to the changes, and that all subsequent transactions by you will be subject to the amended Terms.
7. TRANSACTION
The User should obey the following terms when purchasing investment products on CRYPTOMERIAN:
1) The User undertakes to comply with any and all applicable laws and regulations related to the Transactions.
2) CRYPTOMERIAN holds the right to put a limit on the User’s investment while the User should be responsible for all the information provided to CRYPTOMERIAN in the procedures of transaction.
8. CONCLUSION OF CONTRACT
The conclusion of a contract is made on the User’s purchase of any investment products with CRYPTOMERIAN.
9. TERMINATION OF SERVICES
9.1 The User or CRYPTOMERIAN can terminate one or a few of the services according to their own conditions. CRYPTOMERIAN need not inform any third parties to terminate its services. The User can practice the following rights if there is any conflict:
1) Terminate the use of CRYPTOMERIAN’s services
2) Inform CRYPTOMERIAN to terminate services for the User
9.2 The termination of services becomes effective immediately without the obligation to continue with further services for the User or any third parties
10. USER OBLIGATION
The User undertakes to notify CRYPTOMERIAN immediately of any unauthorized use of his/her Account or password, or any other breach of security by email addressed to [email protected]. Any User who violates the mentioned rules may be terminated, and thereafter held liable for losses incurred by CRYPTOMERIAN or any user of the Site.
10.1 The User undertakes not to use the Service to perform criminal activity of any sort, including but not limited to, money laundering, illegal gambling operations, financing terrorist organizations, or malicious hacking.
10.2 The User is responsible for any and all damages caused and all liability actions brought against CRYPTOMERIAN for infringement of third party rights or violation of applicable laws.
10.3 Nothing in the Service Agreement excludes or limits the liability of the User for fraud, death or personal injury caused by its negligence, breach of terms implied by operation of law, or any other liability which may not by law be limited or excluded.
10.4 Users are solely responsible for determining whether any contemplated Transaction is appropriate for them based on their personal goals, financial status and risk willingness.
11. YOUR ACCOUNT
The User undertakes to immediately (i.e. right after the moment of discovery) inform CRYPTOMERIAN about any unusual, suspicious, unclear or abnormal changes on his/her Account. The User should have be under supervision to use CRYPTOMERIAN services if they are under 18 years old. CRYPTOMERIAN and its affiliates reserve the rights to terminate services, update website and other information.
12. INTELECTUAL PROPERTY RIGHTS
The trademarks, service marks and logos of CRYPTOMERIAN and others used on the Site (hereinafter the “Trademarks”) are the property of CRYPTOMERIAN and its respective owners. The software, text, images, graphics, data, prices, trades, charts, graphs, video and audio materials used on this Site belong to CRYPTOMERIAN. The Trademarks and other materials on the Site should not be copied, reproduced, modified, republished, uploaded, posted, transmitted, scraped, collected or distributed in any form or by any means, no matter manual or automated. The use of any materials from the Site on any other site or a networked computer environment for any other purpose is strictly prohibited; any such unauthorized use may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.
13. FREE SPEECH
Users of this website may post reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." In the event a user uses a false e-mail address, impersonates any person or entity, or otherwise misleads as to the origin of any content. CRYPTOMERIAN reserves the right (but not the obligation) to remove, refuse, delete or edit any content that in the sole judgement of HalleyBT, or terminate your permission to access or use this website.
14. LIMITATION OF LIABILITY
To the extent permitted by law, CRYPTOMERIAN is not responsible for any damages, loss of profit, loss of revenue, loss of business, loss of opportunity, loss of data, indirect or consequential loss unless the loss suffered is caused by a breach of the Service Agreement by CRYPTOMERIAN.
IN NO EVENT WILL COMPANY BE LIABLE TO YOU FOR ANY LOST PROFITS, LOST SAVINGS OR INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF YOUR USE OR INABILITY TO USE THE PRODUCT OR THE BREACH OF THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
15. JURISDICTION
These Service Agreement shall be governed by and construed in accordance with the laws, unless otherwise expressly provided. If any portion of these Service Agreement shall be deemed invalid, void, or for any reason unenforceable, such portion shall be deemed severable and shall not affect the validity and enforceability of any remaining portion.
16. MISCELLANEOUS
16.1 The User is responsible for any and all damages caused and all liability actions brought against CRYPTOMERIAN for infringement of third party rights or violation of applicable laws.
16.2 The User undertakes to read the entire Service Agreement carefully before using the Site or any of the services provided by CRYPTOMERIAN.
16.3 CRYPTOMERIAN reserves the rights of explanation of this Service Agreement
